Estate Planning for Your South Bend Home: Protecting Your Residential Real Estate

Your home is often one of the most valuable assets you own. Making sure it is properly addressed in your estate plan is one of the most important steps you can take to protect your family and avoid unnecessary stress, delays, and expense after you’re gone.

Without clear planning, residential real estate can become the center of family disputes, lengthy probate proceedings, and unexpected costs. Thoughtful estate planning helps ensure your property transfers smoothly to the people you choose, in accordance with your wishes.

Here are some of the most effective ways to handle residential real estate in an Indiana estate plan:

1. Create a Last Will and Testament. A will is the foundation of most estate plans. It allows you to name who will inherit your home and appoint an executor to manage the process. Keep in mind that property left through a will typically goes through probate, which can take time and involve court oversight.

2. Consider a Revocable Living Trust. Many homeowners place their real estate into a revocable living trust. When the property is properly titled in the name of the trust, it can pass to your beneficiaries without going through probate. You retain full control of the property during your lifetime and can change the trust terms as needed. A pour-over will is often paired with a trust to catch any assets that were not transferred into it.

3. Use an Indiana Transfer on Death (TOD) Deed. Indiana law allows property owners to record a Transfer on Death deed. This simple tool lets you name one or more beneficiaries who will automatically receive ownership of the real estate upon your death—without probate. You keep complete control of the property while you’re alive, and you can revoke or change the deed at any time. The deed must be properly signed and recorded in the county where the property is located before your death to be valid.

4. Review How the Property Is Currently Titled: How you own the home matters. A joint tenancy with right of survivorship or a tenancy by the entirety (available to married couples in Indiana) can allow the property to pass automatically to the surviving co-tenant. Understanding your current title is an important first step before making changes.

5. Keep Your Plan Updated: Life changes—marriage, divorce, the birth of children or grandchildren, buying or selling property, or the death of a named beneficiary—should trigger a review of your estate plan. Outdated documents can create confusion and conflict.

6. Coordinate the Rest of Your Plan: While focusing on real estate, don’t overlook related documents such as a durable power of attorney (for financial decisions if you become incapacitated) and healthcare directives. These tools work together with your will or trust to create a complete plan.
